TERMS AND CONDITIONS
1. Scope of Application
These Terms and Conditions (T&C) apply to all orders placed through the online shop of Paradise of Decay, operated by Alexander Zlamal.
By placing an order, you agree to these Terms and Conditions.
2. Contracting Party
The purchase agreement is concluded with:

3. Offer and Conclusion of Contract
The product listings in our online shop do not constitute a legally binding offer, but an invitation to place an order.
By clicking the button “Buy”, you submit a binding order for the items in your cart.
The contract is concluded once we confirm your order by email.
4. Prices and Shipping Costs
All prices are final prices in Euro (€) and include the applicable Austrian VAT.
Shipping costs and taxes are shown separately during the order process.
5. Payment
We accept payments via PayPal and Stripe (credit card / SEPA).
Your account will be charged immediately after completing the checkout process.
6. Delivery
Orders are shipped via postal service or parcel carrier.
Delivery time is usually 3 – 7 business days after receipt of payment.
If an item is temporarily unavailable, we will notify you by email.
7. Retention of Title
The goods remain the property of Paradise of Decay until full payment has been received.
8. Right of Withdrawal (Consumer Cancellation Right)
(1) Consumers within the meaning of § 1 KSchG have the right to withdraw from a distance contract within fourteen (14) days without giving any reason.
The provisions of the Austrian Distance and Off-Premises Contracts Act (FAGG) apply.
(2) The withdrawal period is fourteen days from the day
• on which you or a third party named by you (who is not the carrier) have taken possession of the goods, or
• in the case of partial deliveries: the day on which the last item has been received.
(3) To exercise your right of withdrawal, please inform

by means of a clear declaration (e.g. email) of your decision to withdraw from the contract.
You may use the withdrawal form provided on our website, but this is not mandatory.
(4) If you withdraw from the contract, we will reimburse all payments received from you, including delivery costs (except additional costs arising from your choice of a different delivery method), without undue delay and no later than fourteen (14) days from the day on which we receive your notice of withdrawal.
We will use the same payment method that you used for the original transaction, unless otherwise agreed.
We may withhold reimbursement until we have received the returned goods or you have provided proof that you have sent them back.
(5) You must return the goods without undue delay and in any event no later than fourteen (14) days from the day on which you notified us of the withdrawal, at your own expense.
(6) The right of withdrawal does not apply to
• goods made to the consumer’s specifications or clearly personalized (e.g. custom-printed T-shirts, caps or other personalized items),
• sealed audio or video recordings or software if the seal has been broken after delivery,
• digital content once its delivery has begun with your express consent.
9. Warranty
Statutory warranty rights apply.

10. Liability
We are liable only for damages caused by intent or gross negligence.
For slight negligence, we are liable only for the breach of essential contractual obligations (cardinal duties).
11. Disclaimer
The information, images, and descriptions on our website are provided for general information purposes only.
We do not warrant that the website will be available continuously or free from errors.
Links to external sites are provided for convenience only; we assume no responsibility for their content.
12. Dispute Resolution
Consumers may submit complaints to the EU Online Dispute Resolution Platform:
https://ec.europa.eu/consumers/odr
We are not obliged to participate in a dispute resolution procedure before a consumer arbitration board, but we may do so on a voluntary basis.
13. Final Provisions
Austrian law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).
If any provision of these Terms is or becomes invalid, the validity of the remaining provisions shall remain unaffected.
The contract language is English.
